PENNSBURG
BOROUGH COUNCIL MEETING
Monday,
November 2, 2009 – 7:00 P.M.
The meeting was
called to order at 7:00 P.M. by President John K. Lear.
President Lear led with the Pledge of Allegiance. Answering
roll call were Council Members: President John K. Lear, Vice
President William Clinton, Bruce Lord, Darren Robinson,
Michael Mensch and Douglas Landis.
Also present
this evening was Mayor Vicki Lightcap, Solicitor Charles D.
Garner, Jr., Borough Engineer John Katsaros, Administrative
Assistant Lisa Hiltz, Roads Assistant/Codes Enforcement
Officer Rick Krupp and Administrative
Manager/Secretary-Treasurer Jeanne W. Hopkins.

Comment Period

Consent
Agenda
A Motion was
made by Clinton, seconded by Ritchey and unanimous to
approve the Minutes of the October 6, 2009 meeting and the
October Treasurer’s Report.
Fuel Bid
Openings
Bids for fuel
oil were opened and read. The bids offered are as follows:
Young’s Petroleum, Green Lane - $2.299 - payment made in 30
days
Farm
& Home Oil Co., Telford - $2.559 – payment made in 30 days
A Motion was
made by Clinton, seconded by Ritchey and unanimous to award
the bid of $2.299 to Young’s Petroleum.
Mayor Lightcap
asked to be excused from the meeting.
Roads
Committee
Roads
Assistant, Rick Krupp was present this evening to provide
information on a Stihl Weed Wacker and a 2-way radio for the
new snow plow truck. A Motion was made by Mensch, seconded
by Ritchey and unanimous to purchase the Stihl Week Wacker
at a cost not to exceed $409.00. A Motion was made by
Mensch, seconded by Ritchey and unanimous to purchase the
2-way radio at a cost of $585.00, installed.
Emergency
Management
The next
meeting is scheduled for November 24th at 7:00
P.M. in the Borough Council Chambers.
Municipal
Buildings
Councilor
Ritchey suggested the purchase of new council table chairs.
The matter will be tabled until January 2010.
Revitalization
Vice
President Clinton provided an update on the revised
revitalization plan document. Minor revisions have been
made. A final presentation will be made to Borough Council
Members in December or January 2010.
Police
Commission
President
Lear announced the next meeting has been rescheduled to
Monday, November 16th to be held in the East
Greenville Borough Council Chambers.
Regional
Planning
President
Lear reported the next Comprehensive Plan chapter was
reviewed. The commission discussed forming their own energy
consortium.
Parks/Recreation
The next
meeting is scheduled for Monday, November 9 at 6:00 P.M.

BUSINESS
Zoning
Hearing Board, alternate
No Letters
of Interest were received.
NEW BUSINESS
NPDES
Permit
Borough
Engineer, John Katsaros, provided information on the future
requirements to implement the Permit. The Federal
Government is requiring the Department of Environmental
Protection to oversee and insist the NPDES stormwater
management practices are realized.
Mr. Katsaros
suggested the existing Energy Committee be coupled with an
Environmental Committee to insure the practices are put in
to operation.
BYOB/Sidewalk Café Ordinance
BYOB
Restaurants are not regulated by the Liquor Control Board.
President Lear suggested setting regulations and
guidelines. Council Members will review the material
provided and the matter will be discussed at a future
meeting.
Tax
Anticipation Note
A Motion was
made by Clinton, seconded by Mensch and unanimous to
authorize the Administrative Manager to seek rates for a
TAN.
Montgomery
County Consortium Meeting
A Motion was
made by Lord, seconded by Ritchey and unanimous to authorize
the Administrative Manager to attend the meeting in Lower
Salford Township on November 20, 2009.
The bills for
payment in November were approved for payment with a Motion
by Clinton, seconded by Ritchey and unanimous.
Public
Comment Period
Tom Wargo sent
an email to the borough office questioning the authenticity
of the zoning officers working in the Borough of Pennsburg.
President Lear read a letter from Czop/Specter, Inc.,
verifying the legitimacy of the certifications of Byron Law
and Terry Naugle, employed by Czop/Specter, Inc.
President Lear
explained the difference between borough code enforcement
and building code enforcement. Mr. Wargo had no comment.
Vicki Arcieri,
69 Main St., asked for help in changing the Pennsylvania law
that prohibits a
hairdresser from
renting a chair to another hairdresser. Solicitor Garner
suggested Ms. Arcieri contact her State Senator or State
Representative to try to get the law changed.
The next Budget
Meeting is scheduled for Tuesday, November 10 at 7:00 P.M.
There being no
further business to come before Borough Council at this time
a Motion was made by Councilor Ritchey to adjourn the
meeting at 7:57 P.M.
