PENNSBURG BOROUGH COUNCIL MEETING
Tuesday, November 1, 2011 – 7:00 P.M.

The regular meeting was called to order at 7:00 P.M. by President John K. Lear. President Lear led with the Pledge of Allegiance. Answering roll call were Council Members: Bruce Lord, William C. Clinton, Joan Wider, Douglas Landis, Kristopher Kirkwood, Vice President Michael Mensch and President John K. Lear.

Also present this evening was Mayor Ethel G. Ritchey, Borough Solicitor Charles D. Garner, Jr., Roads Assistant Rick Krupp, Administrative Assistant Lisa Hiltz and Administrative Manager/Secretary-Treasurer Jeanne W. Hopkins.

Visitors
Philip J. Fogli, President and owner of FRS Capital Management, was present this evening to explain new options available for 457 Plan members. FRS Capital Management is the investment advisor of the borough employee’s 457 Plan. The two amendments available are: 1.) Roth Deferral Amendment 2.) "In Service Distribution" option.

A Motion was made by Kirkwood, seconded by Clinton and unanimous to approve the Resolution modifying the 457 Plan which incorporates the two amendments.

Eric Jarrell, Planner, Montgomery County Planning Commission, presented the Regional Comprehensive Plan. A Motion was made by Clinton, seconded by Mensch and unanimous to have a formal public hearing on December 6, 2011.
A Motion was made by Mensch, seconded by Lord and unanimous to authorize the advertisement for the public hearing to take place on December 6, 2011.

Communications
President Lear read thank you letters from the Partnership TMA, Upper Perk Senior Center, Meals on Wheels and The Open Line for recent donations received from the Borough.

Consent Agenda
A Motion was made by Clinton, seconded by Mensch and unanimous to approve the Minutes of the October 4, 2011 and October 25, 2011 Borough Council Meetings and the October Treasurer’s Report.

Roads Department
Councilor Mensch reported the storm damage caused a need for a few extra days of chipping.
Mr. Mensch will work with the Building Committee Chairman, Councilor Kirkwood, to put together a plan and schedule for the roads department in 2012.

Building
Councilor Kirkwood reported the flashing at the roof and cracks on the garage that will need some attention.
President Lear reported the new heaters have been installed.

Revitalization
Councilor Clinton reported the committee met. No action was taken. Mr. Clinton will be attending the next PerkUp committee meeting.

Mayor’s Report
Police Department’s health insurance is being researched.

UNFINISHED BUSINESS
ARLE Grant
There is no news about the grant to date.
Council Members discussed the merits of a super-sized battery back-up. Portable stop signs will be purchased that can be used after the generator’s battery life has been exhausted.

Trash Contract
Councilor Landis reported the trash contract was unanimously approved by the tri-borough trash committee but Red Hill wanted an addition added to say that trash bags cannot be attached to trash cans and that a trash bag can be attached to a bulk item in Red Hill. J.P. Mascaro will need to review and approve this change.

NEW BUSINESS
Revitalization
The contract with Urban Research and Development Corp. to complete engineering at a cost of $12,000.00 for another phase of Main Street revitalization was approved with a Motion by Clinton, seconded by Mensch and unanimous.

2012 Budget
The police budget figure is not yet available. No other line items were discussed.
The next budget meeting will take place on November 15th, as scheduled, if the police budget figures are available by then.

Mowing the Nature Preserve and Pennsburg Community Park in 2012
Eight contractors were contacted and four written were received. Quotes for mowing were reviewed and discussed A Motion was made by Wieder, seconded by Landis and unanimous to accept the proposal of Neihlscape Lawn & Landscape Service, Pottstown for bi-weekly mowing and trimming at a cost of $330.00 per cut upon a favorable review of their references and Certificate of Insurance.
Hiring a contractor to mow will free up the borough employees to complete building and road maintenance that is necessary. Mowing at the civic building and the ball field will be completed by the borough employees.

The November bills for payment, including the additional bill of $250.00 for the 457 Plan Amendments, were approved with a Motion by Landis, seconded by Clinton and unanimous.

Civic Building
Bat removal in the Civic Building. The bat removal company was contacted. Raifsnyder’s Exterminating said the Warranty for the work to remove the bats will not be compromised by any possible repairs and renovations to be completed at the civic building in the near future.

Mold – A quote will be sought to determine if any mold or mold spores exist.

Cardboard drop off
President Lear reported the fire company has agreed to provide two people each month to volunteer their time to collect the cardboard. In exchange, the borough will provide a separate and additional donation of $1,240.00 to offset the borough’s cost to hire part-time people. Firefighters, working on cardboard collection Saturday will not respond to fire calls.

Mold Survey
President Lear directed the Secretary to request a quote to test the air for mold and mold spores. The police department has recently purchased a dehumidifier for areas of their department due to extremely moist areas they discovered as well.

Montgomery Ave. & 11th Street
Councilor Kirkwood reported his observation at the intersection indicates the traffic there is getting worse and not yielding to students attempting to cross at the intersection. No crosswalks are painted at the intersection. Mr. Kirkwood requested this situation be studied. The Secretary was authorized and directed to send a letter to the Upper Perk Police Dept. to request a traffic study be conducted of the intersection.

8:10 P.M. – Executive Session was called to discuss a potential real estate acquisition.

8:28 P.M. – The regular meeting reconvened.

There being no further business to come before Borough Council at this time, a Motion was made by Clinton, seconded by Lord and unanimous to adjourn the meeting at 8:29 P.M.

PENNSBURG BOROUGH COUNCIL MEETING

The Borough Council Meeting was called to order at 7:00 P.M. by President

John K. Lear.  President Lear led with the Pledge of Allegiance.  Answering roll call were Council Members: Bruce Lord, William C. Clinton, Douglas Landis, Kristopher Kirkwood, Joan Wieder, Vice President Michael Mensch and President John K. Lear.

 

Also present this evening was Mayor Ethel G. Ritchey, Administrative Assistant Lisa Hiltz, Roads Assistant Rick Krupp and Administrative Manager/Secretary-Treasurer Jeanne W. Hopkins.

 

Public Comment – None

 

The 2012 Police Budget was reviewed and discussed.  It was noted that the new budget is approximately $1800.00 less than the current budget.  A Motion was made by Clinton, seconded by Landis and unanimous to accept the 2012 budget as presented with a cost of $583,834.00 to Pennsburg Borough.

 

OLD BUSINESS

 

Indoor Air Quality Survey – Civic Building

A proposal by Criterion Laboratories to conduct a survey of surface and air samples for mold spore detection in the downstairs areas of the Civic Building was approved with a Motion by Kirkwood, seconded by Wieder and unanimous at a cost not to exceed $1,360.00.

 

Bat Removal Quote – Civic Building

A quote of $3,000.00 from Raifsnyder Exterminating to provide venting for the Bats to leave the nesting sites but not re-enter was reviewed. Other potential areas of entry will be repaired and sealed as well. The work accomplished by Raifsnyder Exterminating at a cost not to exceed $3,000.00 was approved with a Motion by Clinton, seconded by Landis and unanimous.

2012 Budget

President Lear proposed a small tax increase of .4 mills to offset the costs associated with care and maintenance of the Civic Building and necessary road and storm drain repairs.  Also, he suggested saving money each year for the next eight years to be able to replace the roof when it becomes necessary.  President Lear proposed the tax increase as follows:

            .15 mills to pay for the yearly loan payment = $22,500.00

            .05 mills for roof replacement = $7,500.00

            .2 mills for road improvements = $30,000.00

Councilors Wieder, Kirkwood, Landis and Clinton all favored the tax increase, with each one expressing how unhappy they are to raise taxes.  Councilors Mensch and Lord were opposed to raising taxes.

President Lear added that the safety issue of having no separation from the police station for the borough staff has been an on-going concern.

Heat in the bathrooms and hallway – Rick Krupp was directed to contact an electrician to provide a cost associated with installing space heaters in the downstairs bathrooms and hallway.  The upstairs bathrooms will be winterized by a plumber and portable heaters will be installed.

The majority of Borough Council Members agreed to a tax increase of .4 mills.

Minor adjustments were made to the proposed 2012 budget.

The proposed 2012 Budget has tentative expenditures of $1,541,672.00 and tentative revenues of $1,541,672.00.

 

NEW BUSINESS        

 

Hometown Christmas Parade

A Motion was made by Clinton, seconded by Kirkwood and unanimous to provide $225.00 for oranges upon receipt of a written request from the Upper Perk Association.

 

Snow Plow Attachment for the Bobcat

 A Motion was made by Kirkwood, seconded by Wieder and unanimous to purchase a snow plow attachment for the Bobcat at a cost of $3,184.00 from J D Equipment.  The attachment for the Bobcat will help with better snow plowing within the cul-de-sacs.

The purchase will be split between the accounts of Minor and Major Equipment purchases.  Minor Equipment Purchase - $2,572.61, Major Equipment Purchase $611.39.

 

Cattail Court

A resident of Cattail Court has requested a “Children Playing” sign be installed at the entrance to Cattail Court.  After a lengthy discussion, it was decided that no sign will be installed.  Councilor Mensch will contact the resident to report the decision.

 

2012 Tentative Budget

A Motion was made by Clinton, seconded by Kirkwood and unanimous to advertise the tentative 2012 Budget with Proposed Revenues of $1,541,672.00 and proposed Expenditures of $1,541,672.00, and all Taxes proposed for adoption for the year 2012.

A Motion was made by Clinton, seconded by Lord and unanimous to adjourn the meeting at 8:43 P.M.
